
NRI landlord not returning security deposit in Gurgaon
After living in Gurugram society for more than 3 years, we vacated our apartment on 1st June and have been chasing the landlord (who is a pilot in Qatar Airways, lives in Qatar) for our security deposit of INR 58000.
He picks 1 out of 20 calls (same for texts) and have been unresponsive since.
During our entire stay, we never bothered him for petty repair/maintenance issues and even repainted the house after 2 years at our own expense. We informed him before repainting and he was fine with it (as we didn’t ask him to pay for it).
At first, he said that he will fly back to Delhi, inspect the house and then return the money. On the day of travel, he made excuse that he has fallen sick and hence he has cancelled his flight.
Later he mentioned that because of Iran/Israel war affairs, he cannot fly as the airspace is shut, not sure if this is also an excuse, as few days later he mentioned he is flying to China.
Intermediately, he mentioned some deductions, saying he will pay the rest but then again became unresponsive for next few days, just to bring new deductions.
After few more days of chasing him on calls and texts, he texted mentioning the estimates of deductions 4 deductions and asked us to wait till 8/9th July as he was planning to travel to Gurgaon.
First, he mentioned that since we kept a pet (Labrador) without his consent, he had to get the deep cleaning done to remove the hair, for which he mentioned a deduction of 4800 - We agreed to pay for it as it sounded reasonable. Although we didn’t agree on “without his consent” aspect, we didn’t feel like arguing on this.
Few days later he mentioned that since we repainted the house and changed the colour scheme (we painted 4 asthetic walls into darker shade), he has to get the whole house repainted. We agreed to pay for the repainting of those 4 walls, which was costing around 5000 and to which he initially agreed to. But later changed his mind and became adamant to deduct the money for the whole house repainting.
Then he mentioned deduction of 3500 to change the main door lock. During our stay, we had to change the locks (which we did at our own cost) as we misplaced one of the keys, but returned all the keys back when we vacated the apartment.
Recently, he mentioned that there are marks on the floor (which were there when we moved in, but he denies) for which he has to replace the entire marble.
And now after 53 days today he has transferred 5000 out of 58000 and left a long text asking us to understand, without giving any calculation of the deducted amount.
In all our conversations so far, he has been unresponsive, and giving excuses to delay the repayment.
What should we do?
