
My company is delaying acceptance to my resignation
The company haven’t paid us 3-6months of salary saying that there’s a delay in raising VC funds. They also didn’t pay TDS and gave us Form 16 for ITR.
I reached out to our client company where I worked briefly and they were happy to offer me a job there. I’m dangerously out of money in savings and it’s still uncertain in my current company about any funds. So I have given a early date to him because I really need their salary and joining bonus to survive actually. I thought I can immediately relieve from my current company as I don’t have finished projects and haven’t involve in new. But they are not responding to my calls and mail requesting for immediate resignation.

The best options is: Email all the right people (manager, hr) that you are reigning effective immediately and as per contract your last date will be so and so. Ask for instructions to return company owned assets, etc.
Meanwhile try to arrange loan so that you can survive until you get pay check from next company.

You can also work on contract while serving notice period. This is not legal, but if current company does not know then it’s ok.
Another path is just email your manager that you are moving on as they have not fulfilled their contractual obligation of paying salary. Do you are leaving effective immediately. Don’t even login or use the laptop. Remove company email from phone. Just answer phone calls if you get any. Don’t even respond to email or WhatsApp.
Remember, a company not able to make payroll will not have energy to sue one employee for leaving. They will threaten you, but if you get notice get a local lawyer to give return notice. This should take 10-15k max to start with.
Last option, just don’t work, don’t respond, keep laptop. Join new company or find another one.

Just them what real notice period means, motivate others to put paper down, reject any task they assign to you or give un reasonably long timelines for task.
